Different fathers. Yeah that's the only reasonable explanation. 

Anyway here they are. Rightful Trust's cutie mark basically signifies her role as a lawyer and Ash Fire doesn't have a cutie mark because annoying him beyond all humanity is fun.

I said I'd make him a cutie mark when he hits high school and by then I might forget.

Oh and yes Script and her brother are about the same height, and he's still a filly
